1. Nature of the service
DIYDURO is a GPS timing tool for informal recreational mountain bike events. It records stage times using your phone's GPS. It is not a professionally managed sporting event system and does not monitor rider safety.
2. Assumption of risk
Mountain biking is a high-risk activity. By using this app you acknowledge that you participate entirely at your own risk. You accept the inherent risks of mountain biking including but not limited to falls, collisions, and serious injury. Nothing in these terms excludes liability for death or personal injury caused by negligence as required by the Unfair Contract Terms Act 1977.
3. Organiser responsibilities
If you create stages or events you are solely responsible for: conducting a suitable risk assessment; ensuring the stage is on safe, accessible terrain; obtaining all necessary landowner permissions; informing participants of any hazards; and ensuring appropriate first aid provision is available. DIYDURO accepts no liability for injury or loss arising from stages created by users.
4. Safety — important
This app does not monitor your location during a stage or alert anyone if you do not finish. Always ensure someone knows your planned route and expected return time. Carry appropriate safety equipment. Do not rely on this app in an emergency.
5. GPS accuracy
Stage times are derived from phone GPS and are approximate. Accuracy depends on device hardware, signal conditions, and zone size. Times may differ from true elapsed time by several seconds. Times are for recreational use only and are not suitable for regulated competition.
6. User conduct
You must not create stages on land without permission, on public roads, or in locations that would expose other users to unreasonable risk. You must be 18 or over to use this service.
7. Data
Your use of the app is also governed by our Privacy Policy. By using the service you consent to the collection and storage of GPS track data and stage times as described therein.
8. Changes
We may update these terms. Continued use after an update constitutes acceptance. We will make reasonable efforts to notify users of material changes.
Governing law: Scotland / England and Wales. Any disputes shall be subject to the jurisdiction of the courts of Scotland.
