Please read these Terms of Service ("Terms") carefully before using DIYDURO. By creating an account or using the platform you agree to be bound by these Terms. If you do not agree, do not use the platform.
1. What DIYDURO Is
DIYDURO is a GPS timing tool. It enables users to create timed stage routes, record GPS-derived times, and share results with event participants. DIYDURO is not an event organiser, race promoter, or sporting body. It does not sanction, supervise, or promote any event created on the platform.
Nothing in these Terms or the platform creates an agency, partnership, or employment relationship between DIYDURO and any organiser or participant.
2. Organiser Responsibility
The registered organiser of any event created on DIYDURO is solely and exclusively the legal organiser of that event for all purposes, including but not limited to:
- Obtaining all necessary land access permissions and consents
- Complying with all applicable laws, byelaws, and regulations
- Ensuring the safety and suitability of all stage locations
- Providing adequate first aid provision and emergency planning
- Obtaining appropriate public liability insurance and any other required cover
- Managing participant welfare before, during, and after the event
- Ensuring all participants are informed of the risks involved
DIYDURO accepts no responsibility whatsoever for event safety, land access, participant welfare, insurance, or any claims, losses, or liabilities arising from events created or run on the platform, whether brought by participants, landowners, emergency services, or any other party.
3. No Safety Monitoring
The app does not monitor rider welfare or location during a stage in real time. If a rider enters a stage and does not finish, no alert is sent to anyone — not to the organiser, not to other participants, and not to emergency services.
Users must not rely on DIYDURO as a means of summoning help or alerting others to an incident. Before riding any stage, you must:
- Ensure someone not participating knows your planned route and expected return time
- Carry appropriate safety equipment, including a means of calling for help independent of this app
- Ride within your ability and the conditions
DIYDURO strongly recommends carrying a charged mobile phone, a personal locator beacon (PLB), or another independent emergency device when riding in remote areas.
4. GPS Accuracy and Timing Disclaimer
Timing on DIYDURO is derived entirely from the GPS receiver in your device. GPS accuracy is affected by satellite geometry, terrain, tree cover, atmospheric conditions, and device hardware. Times recorded by DIYDURO are therefore approximate and may differ materially from actual elapsed time through a stage.
DIYDURO makes no warranty, express or implied, as to the accuracy, completeness, or fitness for any purpose of any time recorded on the platform. Times must not be used for official competitive results, prize allocation, or any purpose that requires certified accuracy without independent verification.
Stage start and finish detection uses a configurable proximity radius. A time may be recorded even if you did not ride the full intended stage route. Results are the organiser's responsibility to verify.
5. Limitation of Liability
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by DIYDURO's own negligence (as required by the Unfair Contract Terms Act 1977)
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under applicable law
Subject to the above, to the maximum extent permitted by applicable law:
- DIYDURO's total aggregate liability to you for any claims arising under or in connection with these Terms or your use of the platform, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total subscription fees you have paid to DIYDURO in the 12 months immediately preceding the event giving rise to the claim, or £10, whichever is greater
- DIYDURO shall not be liable for any indirect, incidental, special, consequential, or punitive loss or damage, including loss of profits, loss of revenue, loss of data, loss of goodwill, or loss of anticipated savings, even if advised of the possibility of such loss
You acknowledge that DIYDURO is provided free of charge or at nominal cost, that the above limitations reflect this, and that DIYDURO would not be able to provide the platform on these terms without them.
6. Insurance
DIYDURO does not provide, arrange, or broker any form of insurance. Any links or references to third-party insurance providers displayed within the platform are provided for convenience only as a signposting service.
DIYDURO is not an insurance intermediary and is not authorised or regulated by the Financial Conduct Authority (FCA) in relation to insurance distribution. DIYDURO does not receive commission, referral fees, or any other remuneration in connection with any insurance product purchased via any link displayed on the platform.
Any insurance you purchase is a contract solely between you and the insurer. You are solely responsible for ensuring that any insurance you obtain is adequate for your specific event, activities, and legal obligations.
7. Eligibility and Minimum Age
You must be at least 18 years of age to create an account or participate in any event on DIYDURO. By using the platform you confirm that you are 18 or older. If you are under 18, you must not use DIYDURO. Event organisers must not knowingly permit anyone under 18 to participate in an event created on the platform without the written consent of a parent or guardian and appropriate safeguarding arrangements.
8. Acceptable Use
You agree not to:
- Create events or stages on land you do not have permission to access
- Use the platform for any unlawful purpose
- Attempt to reverse-engineer, decompile, or extract source code from the platform
- Submit false or misleading timing data
- Interfere with the platform's operation or security
9. Intellectual Property
DIYDURO and its content (excluding user-generated content) are owned by DiyDuro.com. GPS track data and event content you create remain yours. By uploading content to the platform you grant DIYDURO a non-exclusive, royalty-free licence to store and display that content for the purpose of operating the platform.
10. Suspension and Termination
DIYDURO may suspend or terminate your account at any time if you breach these Terms, engage in conduct harmful to other users, or for any other reason at DIYDURO's sole discretion. You may delete your account at any time via Settings within the app.
11. Changes to These Terms
DIYDURO may update these Terms from time to time. Material changes will be notified via the app. Continued use after the effective date of any change constitutes acceptance. If you do not agree to updated Terms, you must stop using the platform and delete your account.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Scotland. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the Scottish courts, save that DIYDURO reserves the right to bring proceedings against you in any court of competent jurisdiction.
Note: if the operating entity is based in England or Wales, this clause should be updated to reflect the laws of England and Wales and the jurisdiction of the courts of England and Wales. Confirm with legal counsel before publishing.
